Blue Nautica Charter Conditions

1. Acceptance of Rental Conditions

These general conditions of boat rental regulate the rights and obligations of the lessee (referred to hereafter as the “Charterer”) and the lessor (referred to hereafter as the “charter company” or Blue Nautica). Blue Nautica is referred to hereafter as “BN” and the reservation of a boat through the Blue Nautica web page is referred to hereafter as the “web page”. The Charterer accepts all rental conditions on behalf of themselves and their crew.

2. Rental Price and Payment

The rental price includes the rent of the boat with standard equipment, along with boat and mandatory crew insurance for the rental period. The rental price excludes costs related to domicile marinas (parking, berth, etc.), fuel, skipper service, and other optional services. Pets are not permitted on board.. The Charterer can take responsibility for the reserved boat after paying 50% of the rental price within 7 days of booking confirmation and the remaining 50% at least 4 weeks prior to the rental date. These payment regulations cannot be modified without BN’s consent.

3. Obligations of the Charter Company

The Charter Company agrees to provide the boat to the Charterer in full commission and proper working order, with a full complement of equipment as specified on the BN web page. The boat must be in immaculate condition, with fully filled water and fuel tanks, and delivered at the agreed time with all necessary documentation.If the Charter Company fails to meet these conditions, the Charterer has the right to reimbursement for all days when the boat was unusable. If it is impractical to provide the reserved boat at the agreed time and place, the Charter Company must ensure a substitute boat with the same or better specifications. If a substitute boat is unavailable, the Charterer can cancel the contract and request reimbursement of the rental amount for the unusable days. The Charterer is entitled only to the paid rental amount; all other claims are excluded. If the boat or its equipment is damaged due to unforeseen natural causes, the Charterer must contact the Charter Company immediately. The Charter Company must rectify any damage within 24 hours, and in this case, the Charterer has no right to reimbursement.

4. Deposit

Before taking responsibility for the boat at the marina where it is moored (ACI Marina Trogir), the Charterer must pay a deposit to the Charter Company. The deposit can be paid in cash or by credit card and will be reimbursed after the boat is returned and satisfactorily inspected. The deposit will be fully reimbursed only if no damage has been caused to the boat or its equipment, and no reports of potential damage have been made by third parties during the boat’s usage. If damage is reported or discovered during inspection, the Charter Company will retain part or all of the deposit, equal to the cost of repairs or replacement of missing equipment. If the boat is not returned in a clean and tidy condition, cleaning fees will be deducted from the deposit. If the fuel tanks are not full, the amount required to fill them will also be deducted.

5. Navigation/Skipper License and VHF License

The Charterer must possess a valid navigation license and VHF license, or ensure that a crew member with valid permits or licenses will navigate the vessel.

6. Sailing/Driving Test

A BN/Charter Company representative may require the person navigating the vessel to demonstrate their competence by operating the vessel at sea with the representative aboard. If the person fails to satisfy the representative, the BN/Charter Company may terminate the agreement or place a seaman acceptable to both parties at the Charterer’s expense for as many days as necessary for the safety of the vessel and passengers. Any time required for this test will be part of the agreed charter period.

7. Obligations of the Charterer

After taking responsibility for the boat, the Charterer must sail solely in Croatian territorial waters unless special written approval is obtained to leave. The Charterer must observe all rules and regulations, maintain a boat log, treat the boat and its equipment with utmost care, and sail only in favorable weather conditions with good visibility. The Charterer or their skipper must have navigational skills and hold all necessary licenses for open sea navigation and VHF radio usage. If the boat is involved in an accident or damaged during sailing, the Charterer must inform the Charter Company immediately. Relevant telephone numbers can be found in the boat documentation.

8. Responsibilities of the Charterer

If misdeeds or negligence in boat maneuvering result in damage to a third party not covered by insurance, the Charterer is personally responsible for all material and legal costs. The Charterer is particularly responsible if the boat is confiscated due to unlawful activity. In case of damage oraccident, the Charterer must document the events and obtain written certification from the nearest Port Authority, doctor, or other authorized persons, and inform the Charter Company. If the boat is lost, confiscated, or forbidden to sail by an authorized party, the Charterer must inform the Charter Company and relevant authorities. The Charterer must check the oil level in the motor daily and cover all costs related to damages and losses from a lack of oil. Damages to the underwater section caused by the Charterer’s negligence will be repaired at the Charterer’s expense.

9. Boat Inspection

The Charterer is required to return the boat to the Charter Company at the agreed time and location. The boat must be clean, undamaged, and the fuel tanks must be full. If the Charterer does not return the boat at the agreed time and location, they agree to pay 300% of the daily rate of the full base boat price for each hour overdue. Late returns may be justified in cases of force majeure, provided the Charterer informs the Charter Company immediately.

10. Insurance

Boat insurance is subject to the conditions set by the relevant insurance company. The boat, its equipment, and crew are insured for all types of damage and loss exceeding the franchise/deposit amount. The boat’s guide holds liability insurance for third-party damages. In the case of serious accidents involving other boats, the Charterer must report the incident to authorized persons at the nearest Port Authority Office and obtain all necessary documentation for the insurance company. This documentation should include all relevant information about the causes of the accident and the conditions at the time. The Charterer must inform the Charter Company immediately of any such events. Failure to do so will result in the Charterer being liable for all damages arising from non- reporting or late reporting. The insurance policy covers all damage from inclement weather and natural disasters but does not cover damage from intentional or negligent boat maneuvering. The Charterer cannot use their deposit to pay for such damage and must cover all costs caused by misdeeds or negligence. The insurance policy does not cover damage to the motor caused by a lack of motor oil.

11. Rental Cancellation

If the Charterer and their crew cancel the rental for any reason after entering into an agreement with the Charter Company, BN will retain the entire amount paid for the rental. If the Charterer cancels the rental 4 weeks or more before the charter period, BN will retain 50% of the rental price. If the Charterer cancels less than 4 weeks before the charter period, BN will retain the entire amount. If the Charterer has insured themselves for the charter boat hire and cancels for justified reasons, the insurance company may offer compensation. BN reserves the right to substitute a boat if the reserved boat is damaged due to unforeseen circumstances. In this case, BN will provide a boat with equal or better specifications than the reserved boat. This clause does not apply in cases of war, terrorist activities, natural and nuclear disasters, or other Acts of God, in which BN is not obliged to pay compensation to the Charterer.

12. Complaints

If the Charterer and their crew have any complaints during the charter period, they should inform the Charter Company/BN, who will endeavor to resolve any issues. Only objections and complaints presented in written form during the boat inspection will be considered.
